You are correct. It is an EU ruling. So Americans perhaps may not sell used software but the Europeans on this list may.

Thank you for clarifying.

It's also a marked contrast to the US, which has upheld the right to resell or rent out CDs and DVDs (due to the first-sale doctrine, which lets third parties resell copyrighted works) but has so far allowed software companies to get around the doctrine by claiming that they're selling a "license," not the software itself." (Emphasis Added).

I would also note, that depending upon what Court handed down the decision, it may or may not effect all in Europe.

In general, a Europe Court would have no direct impact on a court in the USA. (Although a US attorney might cite it as precedent possibly in making an argument for the same ruling here.) As a result, I would say that if it is a USA software program, that this ruling has no effect and it would definitely have no impact on US Citizens and software licenses they may own from US companies.

Mon Jan 21, 2013 12:51 pm (PST) . Posted by:"scraphappy98036" scraphappy98036I thought I saw somewhere that the ability to block used software sales was being challenged, since you can sell used books, record albums and such.

Here is a link to an article regarding this: http://www.camshah.com/2012/07/is-selling-used-software-licenses-legal.html

Basically it states that "the court ruled, "the rightsholder can no longer oppose the resale of
that copy." Patches or other changes that are installed after the
original download are also counted as part of the original sale. " It goes on to state that you do have to remove ALL of the software from your computer and you cannot keep backup copies.

Older versions of the software (version 4.1.0 and earlier) are not
legally available from anywhere, including from MTC directly. If you
have a copy of one of these older versions because you use it with a
cricut, then, if you haven't done so already, back it up now.

Check Ebay, craigslist or other groups for people who may want to sell.

If you were downloading what you thought were cutting files, make sure that you have a program installed on your computer that opens the particular file type that you are downloading, or your computer may change the file extension to one that it recognizes. For example, if you are downloading an SVG file, make sure that you have Inkscape or another programs  installed on your computer that open SVG files.

I may be wrong, but, I think you have to open the program MTC, then open it from a menu in there, if that makes sense...been a long day and I am not hitting on all cylinders tonight. However, there IS a program that will allow you to view the mtc file first. HOpe this helps somewhat.

Cricut Craft Room works very much like Design Studio. It includes all the cartridges which DS does not. They have stopped adding new cartridges to DS. I have not had any problems with CCR. Sometimes it tells you that your firmware needs to be updated if you don't have your cricut turned on before you open the program. I have found that you can skip that but you need to save your project, close the program then re-open it with your cricut already switched on.

There is a Cricut forum you can go to as well at www.cricut.com

Good luck.

The article that you linked to is NOT from the USA.  It appears to be from Europe (EU Court of Justice).  However, if you read further down in the article, it states that this is different from in the USA and in the USA you may not resell software because you did not buy the software, but a license to use the software and it is the license that you cannot transfer.

" Overall, though, this ruling is a broad affirmation that digital downloads shouldn't be treated differently from physical sales.

I thought I saw somewhere that the ability to block used software sales was being challenged, since you can sell used books, record albums and such.
